About 'Constitutional Amendment for the Third Term'




1. What is 'Constitutional Amendment for the Third Term'?

 

'Constitutional Amendment for the Third Term (hereafter the Third Term) is a constitutional amendment (change some parts of the law of a country) that had been done to give the then President Junghee Park to serve the third consecutive term on the 14th of September in 1969, who is the fifth, sixth, seventh, eighth, ninth president of Republic of Korea. Consequently the long term seizure of power by President Junghee Park could be succeeded (which means change of the law allowed him to hold position of president for very long time)

 


2. What are the main points of the Third Term?

 

① Permission of election for the third term of a president of Korea.

   (A person can hold a position of president maximum 12 years in a row)


② Permission of concurrent position of a member of the National Assembly to hold a position of a prime minister or a cabinet member

   (A person can hold both position of a prime minister and a cabinet member)


③ Reinforcement of conditions of a resolution of motion of impeachment of a president of Korea (It increased the number of members of the National Assembly who agreed on impeachment (drag someone down from a position of power) of a president which makes hard to impeach a president)


④ Increase in the fixed number of members of the National Assembly

 


3. What is background of the Third Term? and How it happened?

 

The then ruling party (a political party that has major power), Democratic Republic party insisted that strong leadership is very necessary to keep political situation and ensure acceleration (make something fast) of economic construction while a continuous provocation (military annoying action) of North Korea threatens Republic of Korea. So the ruling party pushed the Third Term forward through a campaign to promote public support from citizens and various social organizations.

 

Therefore nationwide protest against the Third Term by more than 20 universities and their students everyday had confronted the police force, and the then opposition party (New Democratic party) struggled to block introduction of the Third Term to the National Assembly by delaying deliberation (discussion) and disorganizing (dismissing) the party itself. Despite of all efforts, a bill for constitutional amendment and referendum (national vote to decide important matter of a country) were approved by 122 members of the ruling party who joined rushing vote for the bills at 2:30 am.

 

Subsequently the ruling and opposition party stumped the whole country to lead public opinion to each party's political advantage on the referendum, the Third Term passed by 5,753,655 votes in favor, 3,636,369 votes in opposition, 414,014 votes in null on October 14, 1969.

 



4. What is a significance of the Third Term?


This constitutional amendment was the 6th constitutional amendment of the constitutional history of Korea. The Third Term had been done to seizure and to extent political power likewise past constitutional amendments. The Third Term allowed a prolonged long-term seizure of power of President Junghee Park and his political system.
